Recognition of foreign judgments

When a judgment is rendered in another province or country (for example in the U.S.A.), often to recover an amount of money, it’s enforceability or execution in the Province of Quebec is not automatic, even if the defendant has property in Quebec.

To be able to execute any foreign judgment in Quebec, said judgment must first be recognized and upheld by a Quebec court. To do so, one must initiate an application to have this judgment homologated. Once this crucial condition has been successfully met, all the judicial means to execute same will be accessible to the beneficiary of the judgment.
